本利用規約（以下「本規約」）は、FENRARK（以下「当ショップ」）が運営するウェブサイト、オンラインストア、SNS、関連サービスその他当ショップが提供するすべてのサービス（以下「本サービス」）の利用条件を定めるものです。

お客様は、本サービスを利用し、商品を注文した時点で、本規約および当ショップが別途定めるプライバシーポリシー、返品・返金ポリシーその他のポリシーに同意したものとみなされます。ご利用前に必ずご確認ください。

第1条 適用範囲

本規約は、本サービスをご利用されるすべてのお客様に適用されます。

当ショップは、必要に応じて本規約を変更できるものとし、変更後の内容は本サービス上へ掲載された時点で効力を生じます。変更後に本サービスを利用された場合、お客様は変更内容に同意したものとみなされます。

第2条 ご利用条件

お客様は、法令、公序良俗、本規約を遵守したうえで本サービスを利用するものとします。

未成年のお客様は、必ず親権者その他法定代理人の同意を得たうえでご利用ください。未成年のお客様が本サービスを利用された場合、法定代理人の同意を得ているものとみなします。

第3条 商品について

当ショップでは、商品画像、サイズ表記、説明文について可能な限り正確な情報掲載に努めておりますが、商品の特性上、個体差が生じる場合があります。

以下の内容については、不良品には該当いたしません。

・サイズ表記に対して1〜3cm程度の誤差
・商品ごとの個体差
・ロゴ、プリント、刺繍位置のわずかなズレ
・縫製や加工の個体差
・軽微な糸のほつれ
・素材特有のにおい、シワ、質感差
・生産時期による仕様変更
・タグデザインやパッケージ変更
・モニターや端末環境による色味の違い
・照明や撮影環境による見え方の違い

海外生産商品を含むため、日本国内基準と比較して縫製や仕上がりに差異が見られる場合があります。

当ショップは、商品の品質に重大な問題がない限り、これらを理由とした返品・返金・交換には対応いたしかねます。

第4条 在庫・販売について

当ショップでは在庫管理に細心の注意を払っておりますが、システム上の誤差や注文集中により、在庫切れが発生する場合があります。

万が一、商品を確保できない場合には、ご注文をキャンセルさせていただく場合があります。

限定商品、予約商品、受注生産商品については、生産状況や物流状況により発送時期が変更される場合があります。

第5条 ご注文について

ご注文完了後は、システム処理上、原則としてキャンセルおよび内容変更はできません。

以下を含む変更には対応いたしかねます。

・サイズ変更
・カラー変更
・商品変更
・数量変更
・配送先住所変更
・メールアドレス変更

ご注文前に必ず注文内容をご確認ください。

お客様都合による入力ミス、住所不備、メールアドレス間違い等によって発生した損害について、当ショップは責任を負いません。

当ショップは、以下に該当すると判断した場合、事前通知なく注文を取消または制限できるものとします。

・不正利用が疑われる注文
・転売目的と判断される注文
・大量購入
・過去にトラブル履歴がある場合
・いたずら注文
・なりすまし注文
・決済不備がある場合
・その他当ショップが不適切と判断した場合

第6条 価格・決済

商品の価格は予告なく変更される場合があります。

ご注文完了後に価格変更が行われた場合でも、ご注文時点の価格が適用されます。

関税、輸入税、各種手数料等が発生する場合は、お客様負担となる場合があります。

決済方法によっては、決済会社または金融機関による審査が行われる場合があります。

決済エラー、カード利用制限、銀行側の処理遅延等について、当ショップは責任を負いません。

第7条 配送について

配送日数はあくまで目安となります。

天候、災害、通関、物流混雑、配送会社都合、国際情勢、繁忙期その他不可抗力により、発送や配送に遅延が発生する場合があります。

配送遅延によるキャンセル、返金、補償には対応できない場合があります。

長期不在、受取拒否、住所不備等により返送された場合、再発送送料はお客様負担となります。

返送後、一定期間ご連絡がない場合、商品を処分させていただく場合があります。

配送完了後の紛失、盗難、置き配トラブル等については、配送会社の調査結果に基づき対応を行います。

第8条 返品・返金・交換

当ショップでは、原則としてお客様都合による返品・返金・交換は承っておりません。

以下を理由とする返品・返金・交換は対象外となります。

・イメージと違う
・サイズが合わない
・注文間違い
・色味の違い
・着用感の違い
・軽微な傷や縫製差
・ロゴやプリント位置の差異
・シワやたたみ跡
・糸のほつれ
・素材感の違い
・配送遅延

誤配送または重大な初期不良があった場合に限り、商品到着後7日以内にContactページよりご連絡ください。

以下の商品は対応対象外となります。

・使用済み商品
・洗濯済み商品
・タグを外した商品
・匂い移りがある商品
・お客様のもとで汚損、破損した商品
・到着後7日以上経過した商品
・セール商品
・限定商品

事前連絡なしで返送された商品は受取拒否となる場合があります。

第9条 禁止事項

お客様は、本サービス利用にあたり、以下の行為を行ってはなりません。

・法令または公序良俗に反する行為
・虚偽情報の登録
・他人になりすます行為
・不正決済
・クレジットカード不正利用
・システムへの不正アクセス
・サーバーへの攻撃行為
・BOT等による不正注文
・転売目的での購入
・営利目的での再販売
・当ショップまたは第三者への迷惑行為
・誹謗中傷
・運営妨害行為
・その他当ショップが不適切と判断する行為

違反が確認された場合、当ショップは注文取消、アカウント停止、今後の利用制限その他必要な措置を行えるものとします。

第10条 知的財産権

本サービス内に掲載されるすべての画像、ロゴ、商品デザイン、文章、動画、商標、コンテンツ等の権利は、当ショップまたは正当な権利者に帰属します。

無断転載、複製、転用、商用利用、再配布、改変等を禁止します。

SNS投稿画像やレビュー投稿について、当ショップはマーケティング目的で利用させていただく場合があります。

第11条 サービス停止・変更

当ショップは、以下の場合に事前通知なく本サービスを停止または変更できるものとします。

・システム保守
・障害発生
・サーバートラブル
・災害
・停電
・外部サービス障害
・その他運営継続が困難と判断した場合

これにより生じた損害について、当ショップは責任を負いません。

第12条 免責事項

当ショップは、本サービスの完全性、正確性、安全性、有用性を保証するものではありません。

本サービス利用に関連して発生した損害について、当ショップに故意または重大な過失がある場合を除き、一切の責任を負いません。

通信環境、端末環境、ブラウザ環境等による表示不具合についても責任を負いません。

当ショップは、以下によって発生した損害について責任を負いません。

・通信障害
・システム障害
・アクセス集中
・配送遅延
・配送事故
・天災
・感染症拡大
・戦争
・規制変更
・第三者サービス障害
・お客様の入力ミス

第13条 個人情報

当ショップによる個人情報の取扱いについては、別途定めるプライバシーポリシーに従うものとします。

第14条 準拠法・管轄

本規約は日本法に準拠します。

本サービスに関連して紛争が生じた場合、当ショップ所在地を管轄する裁判所を第一審の専属的合意管轄裁判所とします。

These Terms of Service (“Terms”) govern the use of the website, online store, social media pages, and all related services operated by FENRARK (“we,” “our,” or “the Shop”) (collectively, the “Services”).

By accessing the Services or placing an order, you agree to be bound by these Terms, as well as our Privacy Policy, Refund Policy, Shipping Policy, and any other policies posted on the Services. Please read these Terms carefully before using the Services.

Article 1 – Scope

These Terms apply to all users of the Services.

We reserve the right to modify or update these Terms at any time without prior notice. Any changes become effective immediately upon being posted on the Services. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.

Article 2 – Conditions of Use

Users must use the Services in compliance with all applicable laws, regulations, public order, and these Terms.

If you are a minor under applicable law, you must obtain permission from a parent or legal guardian before using the Services. By using the Services, minors are deemed to have obtained such consent.

Article 3 – Products

We strive to display product images, sizing information, and descriptions as accurately as possible. However, due to the nature of apparel products and manufacturing processes, slight variations may occur.

The following are not considered defects:

  • Size differences within approximately 1–3 cm

  • Individual product variations

  • Slight misalignment of logos, prints, or embroidery

  • Minor sewing or finishing differences

  • Loose threads or stitching inconsistencies

  • Natural fabric odors, wrinkles, or texture differences

  • Specification changes due to production periods

  • Packaging or tag design changes

  • Color differences caused by monitor or device settings

  • Differences caused by lighting or photography conditions

Some products may be manufactured overseas, and finishing standards may differ from domestic Japanese standards.

Unless there is a major defect affecting the product’s functionality or usability, returns, refunds, or exchanges will not be accepted for the reasons listed above.

Article 4 – Inventory and Sales

While we make every effort to maintain accurate inventory information, stock discrepancies may occur due to system errors or high order volume.

If an item becomes unavailable after purchase, we reserve the right to cancel the order.

Limited items, pre-order items, and made-to-order products may experience delays depending on production or logistics conditions.

Article 5 – Orders

Once an order is placed, cancellations and modifications are generally not permitted due to system processing.

This includes but is not limited to:

  • Size changes

  • Color changes

  • Product changes

  • Quantity changes

  • Shipping address changes

  • Email address changes

Please carefully review all order information before completing your purchase.

We are not responsible for losses or issues caused by customer input errors, including incorrect addresses, missing apartment numbers, or incorrect email information.

We reserve the right to refuse, limit, or cancel any order at our discretion, including orders suspected of:

  • Fraudulent activity

  • Resale purposes

  • Excessive bulk purchasing

  • Previous disputes or violations

  • Fake or prank orders

  • Identity impersonation

  • Payment issues

  • Any behavior deemed inappropriate by the Shop

Article 6 – Pricing and Payment

Product prices are subject to change without prior notice.

Any price changes made after an order is placed will not affect completed purchases.

Customers are responsible for any customs duties, import taxes, processing fees, or additional charges where applicable.

Some payment methods may require authorization or review by payment providers or financial institutions.

We are not responsible for payment failures, card restrictions, bank processing delays, or transaction errors caused by third-party payment providers.

Article 7 – Shipping

Shipping times are estimates only and are not guaranteed.

Delays may occur due to weather conditions, natural disasters, customs inspections, logistics congestion, carrier delays, international situations, peak seasons, or other events beyond our control.

We may not be able to provide compensation, refunds, or cancellations for shipping delays.

If a package is returned due to failed delivery attempts, refusal of delivery, or incorrect address information, reshipping costs may be charged to the customer.

If no response is received from the customer after a returned shipment, the order may eventually be canceled or disposed of.

For lost packages, theft, or unattended delivery issues after delivery completion, we will respond based on the carrier’s investigation and tracking records.

Article 8 – Returns, Refunds, and Exchanges

We generally do not accept returns, refunds, or exchanges due to customer preference or convenience.

The following reasons are not eligible for return, refund, or exchange:

  • Change of mind

  • Incorrect size selection

  • Ordering mistakes

  • Color differences

  • Differences in fit or feel

  • Minor imperfections or stitching differences

  • Logo or print placement differences

  • Wrinkles or folding marks

  • Loose threads

  • Material texture differences

  • Shipping delays

Only cases involving incorrect items or major manufacturing defects may qualify for review. Customers must contact us within 7 days of delivery through the Contact page.

The following items are not eligible for return or exchange:

  • Used items

  • Washed items

  • Items with removed tags

  • Items with odors or stains

  • Damaged items caused by the customer

  • Items reported after 7 days of delivery

  • Sale items

  • Limited edition items

Unauthorized returns may be refused.

Article 9 – Prohibited Activities

Users must not engage in any of the following activities:

  • Violating laws or public order

  • Submitting false information

  • Impersonating others

  • Fraudulent payments

  • Unauthorized credit card use

  • Unauthorized system access

  • Attacks on servers or systems

  • Automated or bot purchases

  • Purchasing for resale purposes

  • Commercial redistribution

  • Harassment or abusive conduct

  • Defamation

  • Disruption of operations

  • Any activity deemed inappropriate by the Shop

If violations are detected, we reserve the right to cancel orders, suspend accounts, restrict future purchases, or take legal action if necessary.

Article 10 – Intellectual Property

All content displayed on the Services, including but not limited to logos, images, product designs, graphics, videos, text, trademarks, and branding, is owned by FENRARK or its rightful licensors.

Unauthorized reproduction, copying, redistribution, modification, or commercial use is strictly prohibited.

Customer-submitted reviews, tagged photos, or social media content may be reposted or used for marketing purposes by the Shop.

Article 11 – Service Suspension and Changes

We reserve the right to suspend, modify, or terminate the Services without prior notice in cases including but not limited to:

  • System maintenance

  • Technical failures

  • Server issues

  • Natural disasters

  • Power outages

  • Third-party service interruptions

  • Situations where continued operation becomes difficult

We are not liable for damages resulting from such interruptions or modifications.

Article 12 – Disclaimer

We do not guarantee that the Services will always be accurate, complete, secure, or error-free.

To the fullest extent permitted by law, FENRARK shall not be liable for any damages arising from the use of the Services unless caused by intentional misconduct or gross negligence on our part.

We are not responsible for issues caused by communication environments, device settings, browser compatibility, or customer-side technical conditions.

We are also not liable for damages caused by:

  • Network failures

  • System errors

  • Traffic overload

  • Shipping delays

  • Delivery accidents

  • Natural disasters

  • Pandemics

  • Wars or conflicts

  • Regulatory changes

  • Third-party service failures

  • Customer input errors

Article 13 – Personal Information

The handling of personal information is governed separately by our Privacy Policy.

Article 14 – Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of Japan.

Any disputes arising in connection with the Services shall be subject to the exclusive jurisdiction of the court having jurisdiction over the Shop’s所在地.
